(BA) and Weichert Real Estate Affiliates, Inc. (WREA). BA and WREA will be referred
to collectively as “we, our or us” as it relates to BA and/or WREA’s Websites, including
the Websites at www.weichertworks.com, www.weichertworks.net, weichert.backagent.net
and any related site maintained and operated by BackAgent and/or WREA (collectively,
the “Website”). We reserve the right, in our sole discretion, to modify or change
this Privacy Policy at any time with or without prior notice to you. You should
visit this page periodically to review the current Privacy Policy; the effective
date will be posted at the top of this Privacy Policy for your convenience. Your
continued use of the Website following the posting of any changes to the Privacy
Policy constitutes your acceptance of those changes. If at any time you do not agree
with this Privacy Policy, you must immediately stop using the Website.
What information we collect: BA and/or WREA may ask for and collect from you personally
identifiable information at certain points throughout the site. Depending on the
information and/or services you request, you may be asked to provide your first
and last name, email address, address, phone number, photograph, MLS identification
number, and Social Security number. If you order a product or service, you may be
asked for financial information such as a credit card number. Once you provide your
personal information, you are not anonymous to us.
How we use your information: We may use your information:
- To process and respond to inquiries and for the purposes for which you provided
the information, such as to receive further information about a product or service.
- To improve the content and navigability of the Website.
- To properly display your listings on website(s).
- To list your contact information on real estate website(s).
- To alert you to new site features, special events, offers and services
- To enforce our Terms of Use.
- In the future, we may sell some or all or our assets or reorganize our corporate
structure. In such transactions, customer information generally is one of the transferred
business assets. In the event of a sale or reorganization of our assets including
our database, customer information may be transferred. We will require recipients
of customer information to honor our privacy policy.
- Who we share the information with: We will disclose your personally identifiable
information to another company only (i) to complete your request, e.g., providing
information about a service, (ii) to outsource one or more of the functions described
in the previous section, (iii) so you may gain access to other Weichert® websites,
(iv) so you may gain leads from Weichert Lead Network, or (v) so you may gain access
to WREA’s Approved Suppliers.
- We may share your information with the proper authorities in response to a subpoena,
legal order or official request, or when we believe you have acted in violation
of our Terms of Use.
- Your Social Security number is used to aggregate your personal production for WREA
award purposes, allow you to gain access to other Weichert websites, and allow you
to gain leads from Weichert Lead Network. We do not display your Social Security
number to the public or in any report; however, your Weichert franchise owner has
access to the administrative feature of this website and can view your Social Security
number for admin purposes.
Where and when we collect information on the Website: In addition to the information
you knowingly provide, we keep track of the domains and IP addresses from which
people visit us. We also collect site usage statistics such as Web browser types
and page requests. This data is not personally identifiable and is used to more
efficiently operate our business, prepare for network load demands, promote our
services and administer the Website. We may share with our affiliates aggregated
statistical information about the use of the Website.
How we collect information: In addition to the information gathered as described
above, there is a technology called "cookies" which can be used to provide you with
tailored information from a Website. A cookie is an element of data that a Website
can send to your browser, which may then store it on your system. We sometimes make
use of cookies on the Website so that we can better serve you when you return to
the Website. You can set your browser to notify you when you receive a cookie, giving
you the chance to decide whether to accept it. However, please note that disabling

When we share your information. We do not sell your personal information. However,
we may share your information with companies affiliated with WREA and our approved

to disclose your personal information. We may also disclose information about you
if we determine that for purposes of national security, law enforcement, or other
issues of public importance, disclosure is necessary or appropriate. We may also
disclose information about you if we determine that disclosure is reasonably necessary
to enforce our terms and conditions or protect our operations or users. Additionally,
in the event of a reorganization, merger, or sale we may transfer any and all personal
information we collect to the relevant third party.
How we protect information: We attempt to protect against the loss, misuse and alteration
of your personal information. Our servers are protected by reasonable physical and
electronic security. We will retain your personal information for the period necessary
to fulfill the purposes outlined in this Privacy Policy unless a longer retention
period is required or permitted by law.
California Privacy Law: We voluntarily abide by the California Privacy Law.
Children: This Website is not directed toward children under the age of 13 years
nor do we knowingly collect information from children under 13. If you are under
13, please do not submit any personally identifiable information to us.
Choice: You may change your preferences relating to the receipt of our information
by going to Manage Preferences. We will use reasonable
efforts to process any change you make.
Governing law: This Privacy Policy shall be governed by and construed in accordance
with the laws of the State of New Jersey and all questions concerning the validity
interpretation or performance of any of the provisions of this Policy or of any
rights, obligations of the Parties hereto shall be enforced in accordance with the
laws of New Jersey. The Parties hereto irrevocably consent to be subject to the
personal jurisdiction of any federal, state, or local court sitting in sitting in
the relevant county of Morris and Essex Counties, New Jersey in connection with
any action to determine any dispute arising under this Policy or to enforce the
provisions hereof.
